(1) You are charged for the time the equipment is in your possession. Your prompt return will save you money. (2) All machines are full of fuel going out on rental, and are to be returned full or customer will be charged for the fill up by RTI Quality Rentals, Inc. (3) A cleaning charge minimum of $150.00 will be charged if machine is returned dirty. (4) Replacement of malfunctioning equipment- if the equipment becomes unsafe or in disrepair as a result of normal use, customer agrees to discontinue use and notify dealer who will replace the equipment with similar equipment in good working order, if available. Dealer is not responsible for any incidental or consequential damages caused by malfunction, delays, or otherwise. (5) “In consideration of Lessor delivering these rental items to party signing contract, said party if not actual Lessee, assumes responsibility of Lessee herein. This shall not affect the obligation of Lessee with respect to this contract.”

The above named Lessee hereby leases the above described equipment from Lessor (RTI Quality Rentals, Inc.) and agrees to the above and to the terms and conditions attached or shown at time of rental, such terms and conditions include provisions disclaiming warranties and limiting Lessee’s remedies and Lessor’s liability. Lessee acknowledges that (a) Lessee, or the person signing below on Lessee’s behalf, has read and understands and agrees to be bound by such terms and conditions; (b) Lessee has been offered an opportunity to fully examine the equipment; (c) Lessee has received from Lessor one or more instruction manuals pertaining to the equipment; and (d) safe operation of the equipment requires observation of the instructions therein contained with respect to operation, service, maintenance, and other matters. Lessee represents and warrants that the equipment in leased for commercial use. Terms of payment: the undersigned agrees to payment in advance where no credit or unsatisfactory credit has been established. Payment is due upon receipt of invoice where open credit is established. Lessee agrees to pay a service charge of 1.5% per month on accounts past due 30 days from invoice, and to pay reasonable attorney’s fees and collection costs if its account is placed with an attorney for collection.
